All content on this website (texts, photographs, 3D models, logo, visual identity) is the exclusive property of Portrait 3D Belgium, unless stated otherwise. Any reproduction, representation or adaptation, in whole or in part, without prior written permission is prohibited.

The 3D models produced as part of an order remain the intellectual property of Portrait 3D Belgium. The customer acquires ownership of the physical object delivered, not of the digital files, unless separately agreed in writing.

General terms and conditions of sale

1. Purpose

These terms govern orders for custom 3D figurines and portraits produced by Portrait 3D Belgium for private or professional customers.

2. Order and quote

Every order is preceded by a free quote, drawn up on the basis of the photos and information supplied by the customer. The quote states the price, size, finish, options and lead time. The order becomes firm once the quote is accepted in writing and the deposit is paid.

3. Prices and payment

Prices are expressed in euros. A 30 % deposit is payable at the time of order; it covers the start of the modelling work. The balance is payable before shipping. Shipping costs are charged separately and stated on the quote.

4. Lead times

The standard lead time is 10 to 20 working days; the express option is 7 days (+20 %). This period runs from the customer's approval of the 3D preview. Lead times are indicative; a reasonable delay does not give rise to cancellation or compensation.

5. Approval before printing

The customer receives a preview of the 3D modelling before printing and may request adjustments. Written approval of this preview constitutes acceptance of the result. After approval, no change can be made without a new quote.

6. Right of withdrawal

In accordance with article VI.53, 4° of the Belgian Code of Economic Law, the 14-day right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised. As our figurines are entirely personalised, they cannot be returned or exchanged.

7. Delivery, breakage and defects

Every piece is shipped in reinforced packaging with a tracking number. In the event of breakage in transit, the customer has 48 hours from receipt to report the damage with photos of the parcel and the piece; the piece is then remade or refunded. The two-year legal guarantee of conformity applies to manufacturing defects.

8. Photos supplied by the customer

The customer warrants that they hold the rights to the photos supplied and the consent of the people depicted. Portrait 3D Belgium cannot be held liable for any use of photos that infringes the rights of third parties.

9. Liability

The likeness achieved depends on the quality and number of photos supplied. Portrait 3D Belgium undertakes a best-efforts obligation and informs the customer if the photos supplied will not allow a satisfactory result.

10. Applicable law

These terms are governed by Belgian law. In the event of a dispute, an amicable solution will be sought first. Consumers may turn to the Consumer Mediation Service (FPS Economy) or to the European online dispute resolution platform.

Data protection (GDPR)

Data collected

Through the quote form we collect: name, email address, phone number (optional), project description and the photos supplied. This data is necessary to prepare a quote and fulfil the order.

Purpose and legal basis

Data is processed in order to respond to your request and perform the contract (article 6.1.b GDPR), as well as to meet our accounting and tax obligations (article 6.1.c).

Retention period

Requests that do not lead to an order are deleted no later than 12 months after the last exchange. Data linked to an order is kept for as long as Belgian accounting law requires (7 years for supporting documents). Source photos are deleted on simple request.

Recipients

Your data is never sold, rented or passed to third parties for commercial purposes. Only strictly necessary service providers (host, mail service, carrier for delivery) have access to it in the course of their work.

Publishing your figurine

No photo of your creation is published on our social media without your explicit, prior consent.

Your rights

You have the right of access, rectification, erasure, restriction, objection and portability. To exercise them, write to portrait3dbelgium@gmail.com. You may also lodge a complaint with the Belgian Data Protection Authority (dataprotectionauthority.be).

Cookies

This website sets no tracking or advertising cookies. Only a technical local storage entry is used to remember the language you chose. No third-party analytics tool is installed by default.
